07-06-2010: LDM working with province in ‘System focussed supervision’ pilot project

The province of Noord Brabant is responsible for ensuring that LDM complies with environmental legislation and regulations. Recently, a study was undertaken into how this supervision could better connect into the care systems within businesses. This led to the ‘System focussed supervision’ pilot project. LDM has been taking part in this trial since the beginning of the year.

A different form of supervision

‘System focussed supervision’ shifts attention from checking actual compliance to ensuring that care systems are functioning appropriately. Visits by the Enforcement department are not always deemed to be very useful by the companies involved and the enforcers themselves also find that they cannot always carry out their work effectively. Effective care systems provide a great deal of added value for a company. They are extremely beneficial. Focussing enforcement on the effectiveness of the environmental care system creates a beneficial system for both parties. Requirements imposed on businesses in this regard are exceptionally strict but it has been shown extensively, in the past, that if participating companies have an effective environmental care system, it provides a good basis for confidence and, as a result, the companies are more willing to continue to do business in a socially responsible manner.

Pioneer

The province of Noord Brabant is one of the pioneers in the Netherlands when it comes to System focussed supervision. This modern approach has led to the province serving as a central information point on a national basis and its working method is making a significant contribution towards the development of a national approach. The improvements, critical process and national developments are also leading to further developments in established policy.

Five steps

The province carries out five steps within the process of System focussed supervision:
1. They conduct a quick scan into compliance competencies in consultation with the participating company.
2. A recommendation is then provided, on the basis of the scan.
3. As a result of this, the province then makes agreements on improvement areas in order to grow towards an improved level of compliance (internal supervision of compliance with legislation and regulations).
4. Agreements are made about the extent of supervision required according to the level of compliance.
5. Once a year, the province checks the progress and agreements on the basis of the set compliance and supervision levels.
